THE WA REQUEST

Fairness from investigation to hearing.

Criminal allegations can affect liberty, employment, reputation, finances and family relationships before a final outcome is reached. Justice Before Judgment calls for processes that protect complainants, children and the community while preserving fair-hearing safeguards for accused people.

This is not a demand for automatic disbelief or automatic punishment. It is a request for objective investigation, appropriate disclosure, access to essential assistance and decisions based on properly examined material.

Five principles for a stronger process

Objective investigation

Relevant material that supports or contradicts a serious claim should be considered without predetermining the outcome.

Timely lawful disclosure

People should receive the material they are legally entitled to in time to understand and answer the case.

Presumption of innocence

Protective action and careful investigation can occur without treating an allegation as a final finding of guilt.

Access to essential representation

The ability to obtain meaningful legal assistance should not depend entirely on personal wealth.

Evidence-based accountability

Proven deliberate fabrication should be distinguished from mistake, inconsistency or a good-faith report that cannot ultimately be established.

BALANCED POSITION

Protection and fairness belong together.

  • Genuine victims must be able to report safely and be treated with dignity.
  • Children and immediate safety risks must be addressed promptly.
  • An unproven allegation is not automatically a deliberately false allegation.
  • No person should be harassed, publicly named or targeted through this campaign.
